These General Conditions regulate the acquisition of the products offered on the website https://dream-fontanilles.com, of which DREAM FONTANILLES holds, S.L. (hereinafter, DREAM Fontanilles).
The acquisition of any of the products entails the full and unreserved acceptance of all and each of the General Conditions indicated, without prejudice to the acceptance of the Particular Conditions that may be applicable when acquiring certain products.
These General Conditions may be modified without prior notice, therefore it is advisable to read your content carefully before proceeding to purchase any of the products offered.

The products offered, along with the main features of them and their price appear on screen. DREAM Fontanilles reserves the right to decide, at each time, the products and/or services offered to the Customers. In this way, DREAM Fontanilles can, at any time, add new products and/or services to the currently offered ones. Also, DREAM Fontanilles reserves the right to withdraw or cease offering, at any time, and without notice, any of the products offered.
All this without prejudice to the fact that the purchase of the products can only be done by subscription or registration of the USER, by selecting from the interested party a Username and a password, which will identify and enable you personally to access the products. If DREAM Fontanilles is unreasonably delayed in the return of the amounts paid, the consumer may claim twice the amount due.
5. PROCESSING AND/OR CONTRACTING

FORMAS AND INTERREGES
1. Through land transport by agency:
Our commitment to the delivery times for Spain and Portugal is 2 to 8 days maximum. Orders made on our website before 13:00, on working days will be prepared and delivered to the carrier on the same day, for orders requested after 13:00 the delivery time to the carrier will be extended by 24 Hours

DREAM Fontanilles reserves the right to vary the type of shipment and the company by which the shipment is made, regardless of what is stated on this website and provided that it does not imply a manifest damage to the customer. Any change/modification in the form, dates or transport company will be communicated to the customer by e-mail.
7. PRICES, EXPENSES AND IMPESTS
The prices of the products collected in https://dream-fontanilles.com they will be expressed in Euros unless otherwise expressed and will be guaranteed during the time of validity of the same, except printing error and whatever the destination of the order.

• The products have VAT included, except for shipments to the Canary Islands, Ceuta, Melilla and non-European Customs Union areas, in which case the corresponding tax or fee will be applied.

9. POLICY OF DESISTANCE AND REVOLUTIONS
According to the regulations, the consumer and user shall have the right to DESISTIR of the contract for a maximum period of 14 calendar days without the need to indicate the reason and without incurring any cost, except those provided for in the article. 107.2 and 108 of the RD1/2007, of 16 November, adopting the text referred to in the General Law for the Defense of Consumers and Users.
The customer will have a maximum period of 14 calendar days from the day of receipt of the requested good or product to inform DREAM Fontanilles about his desire to withdraw from the contract.
The withdrawal implies that, DREAM Fontanilles will proceed to the refund of the amount already paid by the customer within a maximum of 14 calendar days, following the same procedure chosen by the customer for its subscription.
During this period, the consumer will notify the entrepreneur of his decision to withdraw from the contract by filling out the form at the end of this document and sending it to the email address of DREAM Fontanilles.
DREAM Fontanilles will communicate to the consumer in durable support an acknowledgement of such withdrawal.
To proceed with the return of a product it is essential that it is in perfect condition and with its corresponding original wrapping (with the precinct and/or film indemnified, as well as with its corporate tape), with all its accessories and without having been used.
Once we receive your request we will contact the customer to indicate the details of the return.
The customer will bear the costs of returning the goods.
REVOLUTIONS
In the event that the consumer/user wishes to return the product for lack of conformity must communicate it before 3 working days from receipt and in any case the return must be approved by DREAM Fontanilles. All expenses generated by the return will be borne by the consumer/user.

10. GARANTIA

Except for proof to the contrary, the delivery is understood to be made on the day on the invoice or check-in, or on the corresponding delivery note if it were later.
In cases where the use of the warranty is justified, the replacement of the damaged product or the return, in the legally established terms, shall be carried out. The expenses arising from the return of this will be borne by DREAM Fontanilles.
In durable products, the consumer will be entitled to adequate technical service and spare parts for a minimum of 5 years from the date the product ceases to be manufactured, without increasing the price of spare parts when applied in repairs.

If, however, the purchased product does not work properly, you must immediately contact the customer service and technical assistance of the manufacturer, or in your case of the representative or distributor.

Any dispute that arises about the application of the guarantee will be resolved as follows: the customer will send the product purchased to the DREAM Fontanilles installations, who will appreciate if the intervention of a car expert authorized by the insurance companies is necessary, in which case, the part to which the expert report does not give the reason.
EXCLUSIONS
They are excluded from the guarantee:
The deteriorations caused by the wear of the use, by accident or any modification that has not been specifically recommended. This includes improper or erroneous assembly or an unqualified person, as well as inadequate or unused maintenance or use not in accordance with the intended use of the manufacturer, the use of competition, trout vehicles, rallye, raid and other similar disciplines except if this case had been provided under the warranty coverage conditions by the supplier that makes the product in question. Guarantees exclude consumable products, deficiencies caused by undue use or manipulation, connection to the grid other than the one indicated, incorrect installation or defects derived from any external cause.
The lack of conformity resulting from an incorrect installation of the product shall be equivalent to the lack of conformity of the product when the installation is included in the contract of sale or supply regulated in article 115.1 of the LGDCU and has been made by the seller or under its responsibility, or by the consumer and user when the defective installation is due to an error in the installation instructions.
The warranty will not be applicable when the failure, deterioration, malfunction, etc., is caused by the incorrect installation of the product or by being installed in a system or set in poor condition or with damaged materials.
11. RESPONSIBILITY AND EXONERATION OF RESPONSIBILITY
The consumer and user has the right to repair the product, its substitution, the reduction of the price or the resolution of the contract, as set out in Chapter II. IV Book II of the General Law for Consumer and User Defense.
If the product is not in conformity with the contract, the consumer may choose between the repair or replacement of the product, both of which are free for the consumer, which will take place within a reasonable time depending on the nature of the products and the purpose to which they were intended.
If the repair and delivery of the product is completed, the product remains not in accordance with the contract, the consumer may demand its replacement, the price reduction or the contract resolution.

13. APPLICABLE LEGISLATION
The present conditions shall be governed by the Spanish legislation in force and in particular by:
• Law 7/1998 of 13 April on General Conditions of Contract
• Royal Legislative Decree 1/2007 of 16 November, General Law for the Defense of Consumers and Users
• Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, as well as the General Data Protection Regulation (GDP)
• Law 34/2002 of 11 July on Information Society and Electronic Commerce Services.
In the event of any discrepancy or dispute arising from the interpretation or application of these Terms of Use or the content of the website, in general, DREAM Fontanilles and the user, with express waiver of any other jurisdiction that might correspond to them, are subject to the jurisdiction of the Courts and Tribunals of the user's home. In the event that the user has his or her domicile outside Spain, DREAM Fontanilles and the user, with express renunciation of any other jurisdiction that might correspond to them, submit to the jurisdiction of the Girona Courts and Courts
